PLEASE READ THESE TERMS OF USE ("AGREEMENT" OR "TERMS") CAREFULLY BEFORE USING WWW.WRITERSBLOCKBOXES.COM (THE "SITE") OR ANY SERVICE OFFERED BY AUTHOR BY DESIGN DBA WRITER'S BLOCK BOX ("COMPANY," "WE," OR "US"). BY VISITING, BROWSING, OR USING THE SITE, YOU AGREE TO BE BOUND BY THIS AGREEMENT.

1. ABOUT OUR SERVICE

Author by Design dba Writer's Block Box operates an online writing community and offers subscription box services for fiction writers. Our community exists on our website and social media platforms including Facebook, Instagram, Pinterest, Twitter, YouTube, and TikTok.

Our Services Include:
  • Monthly Writer's Block Box subscriptions
  • Journey Box (12-month guided writing experience)
  • Theme and Genre Boxes
  • Individual writing tools and products
  • Digital workshops and classes through SisterScribe Academy

2. ELIGIBILITY

Age Requirements: You must be at least 13 years old. Users under 18 must use the site under parent or legal guardian supervision.
Geographic Restrictions: Our subscription services are available only to residents of the United States, its territories, and Canada. The website may be accessed globally for informational purposes.
Account Responsibility: You are responsible for maintaining account confidentiality and all activities under your account.

3. SUBSCRIPTION SERVICES

Monthly Subscription: Automatically renews monthly at current rates until cancelled. You may cancel anytime through your account or by emailing writersblockboxes@gmail.com.
6-Month Subscription: Prepaid service that auto-renews every 6 months. We will notify you before renewal charges.
Annual Subscription: Prepaid service that auto-renews yearly. We will notify you before renewal charges.
Journey Box: 12-month guided writing experience with specialized content for each month.
Character Box: Focused on character development tools and resources.
Pricing: All prices are in USD and include applicable taxes. Current subscription rates are available at writersblockboxes.com.

4. SHIPPING AND DELIVERY POLICY

Address Requirements: All shipping addresses must be complete, accurate, and pass our address verification system. You are responsible for providing correct addresses including apartment/suite numbers and zip codes.
Undeliverable Packages: If a package is returned as undeliverable due to incorrect address information:
  • We will contact you within 48 hours via email
  • Your subscription will be paused until a verified address is provided
  • You have 10 business days to respond with address corrections
  • Subscriptions remain paused for up to 30 days before potential cancellation
Address Changes: You must notify us immediately of address changes by emailing writersblockboxes@gmail.com.
Risk of Loss: Title and risk of loss pass to you upon delivery to the carrier.

5. BILLING AND PAYMENTS

Payment Methods: We accept credit cards, debit cards, and other approved payment methods.
Automatic Renewal: Subscription services automatically renew unless cancelled. We may attempt to charge failed payment methods until successful.
Taxes: Prices include applicable sales taxes based on your shipping address.
Failed Payments: If payment fails, we may pause your subscription until payment is resolved.

6. CANCELLATION AND REFUNDS

Cancellation: Cancel anytime through your account dashboard or by emailing writersblockboxes@gmail.com. Cancellations take effect at the end of your current billing period.
No Returns Policy: Physical products cannot be returned. Contact us with any product concerns and we will work to address them.
Refund Policy:
  • Monthly subscriptions: No refunds for current month's charges
  • Prepaid subscriptions: Refunds for unused months may be provided for unresolvable shipping issues, minus processing fees and shipped boxes
  • We reserve the right to issue refunds at our discretion

7. PROHIBITED USES

You may not use our services to:
  • Submit false, defamatory, or illegal content
  • Impersonate others or misrepresent affiliations
  • Resell products (personal use only)
  • Attempt unauthorized access to our systems
  • Harass, intimidate, or harm others
  • Spam or send unsolicited communications
  • Violate any applicable laws

8. INTELLECTUAL PROPERTY

Our Content: We own all rights to site content, design, and materials except user-submitted content.
Your Content: You retain ownership of content you submit but grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content for business purposes.
Limited Use: You may view and print site content for personal, non-commercial use only.

9. PRIVACY AND COMMUNICATIONS

Privacy Policy: Our Privacy Policy explains how we collect, use, and protect your information.
SMS Terms: By providing your mobile number, you consent to receive text messages about products, promotions, and shipping updates. Reply STOP to cancel, HELP for assistance. Message and data rates may apply.
Email Communications: We may send service-related emails and promotional communications. You can opt out of promotional emails.

10. DISCLAIMERS

"AS IS" SERVICE: We provide our services "as is" without warranties of any kind.
No Professional Advice: Our content is for informational purposes only and does not constitute professional advice.
Third-Party Content: We are not responsible for user-generated content or third-party links.

11. LIMITATION OF LIABILITY

OUR LIABILITY TO YOU IS LIMITED TO THE GREATER OF: (1) FEES YOU PAID IN THE 12 MONTHS PRIOR TO THE CLAIM, OR (2) $100 USD.
WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

12. DISPUTE RESOLUTION

Contact Us First: For disputes, contact writersblockboxes@gmail.com. We will work to resolve issues promptly.
Arbitration Agreement: If informal resolution fails, disputes will be resolved through binding arbitration under American Arbitration Association rules, not in court.
Individual Claims Only: No class action lawsuits or consolidated proceedings are permitted.
Exceptions: Intellectual property disputes and small claims court cases are excluded from arbitration.
Location: Arbitration will occur in your county of residence or Arapahoe County, Colorado.
Costs: We will pay arbitration costs for claims under $10,000.

13. GOVERNING LAW

These terms are governed by Colorado state law and U.S. federal law, without regard to conflict of law principles.

14. GENERAL PROVISIONS

Entire Agreement: These terms, along with our Privacy Policy and other referenced policies, constitute the complete agreement.
Modifications: We may update these terms at any time. Material changes will be communicated to users.
Severability: If any provision is unenforceable, the remainder stays in effect.
No Waiver: Our failure to enforce any right does not waive that right.
